Terms of Service
Effective Date: 9/8/2025
Welcome to Kyle’s Karate (“we,” “our,” “us”). By registering yourself or your child for our programs, you agree to the following terms and policies. These Terms of Service, including the Injury Waiver & Release of Liability, apply to all Kyle’s Karate programs, including group classes, after-school programs, private lessons, and special events such as birthday parties.
1. Enrollment & Payments
Auto-Enrolling Programs (Chesterbrook Academy – Olney, Aldie, Kentlands – and Bethesda Country Day School):
These programs are auto-enrolling. Your child will automatically be re-enrolled for each subsequent session of the school year unless you cancel in writing via email to Kyle’s Karate or the school.
Tuition for these locations is paid directly to the school.
Parents will be notified before each new session begins.
Other School-Handled Programs (Seneca Academy, Henrietta Lacks Elementary School ASEP):
Tuition for these programs is handled directly by the school or PTA.
Some schools may require their own registration forms — it is the parent’s responsibility to complete any school-specific requirements.
Registration through our website provides us with contact information, waiver acknowledgment, and roster details, but does not handle payment.
Direct-to-Kyle’s Karate Programs (All Others):
Registration and payment are completed directly through our website.
Enrollment is not confirmed until payment is received.
Unless otherwise noted, all payments are non-refundable. Refunds may only be granted in rare circumstances at the discretion of Kyle’s Karate.
2. Private Lessons & Special Events
These Terms, including the Injury Waiver & Release of Liability, apply to all Kyle’s Karate programs, including private lessons, workshops, and special events such as birthday parties. Payment for these services is typically handled by invoice through a secure third-party processor (e.g., Square). By paying an invoice, you agree to the charges described and acknowledge acceptance of the Terms of Service and Injury Waiver. For recurring invoices (e.g., ongoing weekly lessons), payment constitutes authorization for Kyle’s Karate to process charges for each scheduled session until cancelled in writing.
3. Cancellations & Makeups
If Kyle’s Karate cancels a class (e.g., due to instructor illness or scheduling conflict), we will work with the school to arrange a makeup session and notify you by email.
Makeup days only apply to cancelled classes. We cannot offer makeups for student absences.
In the event of school closures (e.g., weather, pandemic shutdowns), we cannot guarantee that all missed classes will be rescheduled.
4. Communication
Email is our official method of contact. All updates, cancellations, and important information will be sent to the address(es) you provide.
We do not send marketing emails. Communication is limited to program participation.
5. Injury Waiver & Assumption of Risk
Participation in karate and physical activity carries inherent risks. By registering, you affirm that you (or your child) are in good physical condition and able to participate. You acknowledge these risks and agree to release Kyle’s Karate, its owners, employees, subcontractors, independent contractors, instructors, assistants, and partner schools from liability for any injury, illness, or condition arising from participation, except in cases of gross negligence.

6. Photo Use & Consent
Class Reports (Required): By enrolling, you agree that Kyle’s Karate may take photos and/or short video clips during class sessions. These are used exclusively for weekly class reports, which are shared privately with the parents/guardians of enrolled students in that class. Reports may be sent via email, either as direct attachments or as links to private shared albums (e.g., Google Photos). These photos/videos will not be used publicly unless you have opted in for promotional use (see below).
Promotional Use (Optional): Parents may voluntarily opt-in to allow photos/videos to be used for promotional purposes (e.g., website, flyers, social media). Opting in is not required for participation.
7. Student Conduct
Students are expected to follow class rules, respect instructors, and behave safely. We reserve the right to remove any student whose behavior is disruptive or unsafe.
8. Intellectual Property
All teaching materials, curriculum, and content created by Kyle’s Karate remain our property. They may not be copied, reproduced, or distributed without permission.
9. Limitation of Liability
To the fullest extent permitted by law, Kyle’s Karate, its owners, employees, subcontractors, independent contractors, instructors, assistants, and partner schools shall not be liable for any indirect, incidental, or consequential damages. Total liability for any claims related to participation shall not exceed the total tuition paid for the program.
10. Governing Law
These Terms are governed by the laws of the State of Maryland, USA.
11. Updates
We may update these Terms from time to time. Continued participation after changes are posted constitutes acceptance of the updated terms.
